Adequacy Determination process

Format and content

Part 4410.2800, subp. 4 addresses the conditions that must be met, the Final EIS (FEIS) shall be determined adequate if it:

  • Addresses and analyzes (in conformance with MEPA rules) the potentially significant issues and alternatives raised in scoping
  • Provides responses to the substantive comments received during the Draft EIS review concerning issues raised in scoping
  • Has been prepared in compliance with the procedures of MEPA

MnDOT addresses these conditions in a decision by the Director of the Office of Environmental Stewardship (OES). A letter conveying the Adequacy Determination is sent to everyone who received a copy of the Final EIS.

Circulation/processing

Document preparation – The Office of Environmental Stewardship prepares the Adequacy Determination letter, and MnDOT's Chief Environmental Officer signs it. It cannot be completed until at least 10 working days after the Notice of Availability of the FEIS appears in the MEQB Monitor. At MnDOT, it is typically done concurrently with the ROD.

Distribution – The Adequacy Determination is distributed to everyone who received a copy of the FEIS. The Project Manager distributes the Adequacy Determination to the federal and state agencies on the EIS Distribution List (PDF), to local governments and agencies, and to citizens and organizations who received a copy of the FEIS or FEIS summary.

Notification – OES is responsible for notifying the MEQB to place the Adequacy Determination in the MEQB Monitor.
