Delegated Contracting Process updated to include
important Title VI requirement

The Federal Highway Administration (FHWA) requires every subrecipient of federal financial assistance to sign and utilize the Standard Title VI/Non-Discrimination Assurances. The assurances document is intended to commit subrecipients to ensuring compliance with Title VI of the Civil Rights Act of 1964, which prohibits recipients from discriminating against the public based on race, color, or national origin.

To better ensure this requirement is being met, MnDOT State Aid for Local Transportation has updated the Delegated Contracting Process (DCP) to include the assurances document requirement when local public agencies submit the Request for Contracting Authority (DCP 01). Local public agencies will now be required to submit a signed assurances document as an attachment to the Request for Contracting Authority.

The assurances document includes appendices to be utilized in various types of contracts, and the document provides instructions explaining how the appendices should be used. Appendix A and E should be in every contract or agreement, and Appendix B, C, and D are to be used in various types of real estate agreements. Local public agencies are encouraged to review the assurances document to better understand the general provisions and appendices.
