Public Notice and Opportunity for Comment
The Minnesota Department of Transportation (MnDOT) proposes pavement rehabilitation along Trunk Highway (TH) 60 from TH 14 to the City of Waterville. Additional project components include the addition of some right and left turn lanes, guardrail and culvert adjustments, and pedestrian facility updates to meet Americans with Disabilities Act (ADA) compliance within the Cities of Madison Lake and Elysian. Highway accesses will be improved, and redundant accesses consolidated or removed.
In accordance with Section 6009 of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) Public Law 109-59, enacted August 10, 2005, MnDOT is soliciting comments on the effects this project would have on the Sakatah State Trail owned by the Minnesota Department of Natural Resources (MnDNR). The project will impact approximately 0.726 acres of MnDNR right of way, which is also a 6(f) resource. The trail itself will not be impacted by these permanent easements.
The Federal Highway Administration (FHWA) has made a preliminary determination that the proposed action at Sakatah State Trail is a Section 4(f) de minimis action in accordance with Section 6009(a) of SAFETEA-LU, conditioned on public review and comment. A de minimis finding may be made when uses of Section 4(f) land will have no adverse effect on the protected resources.
