Programmatic Agreements

MnDOT, with their partners at the Federal Highway Administration (FHWA) and the State Historic Preservation Office (SHPO), have developed two important Section 106 programmatic agreements. Programmatic agreements, as defined by 36CFR 800.14, are negotiated to implement and monitor a particular program and/or create an agreed upon method of meeting Section 106 obligations or projects with similar resource types or similar impacts. These agreements enable agencies to streamline the environmental review process while providing stipulations that assure a consistent review process to a type or class of Section 106 reviews.
