All contractors who are working on federal-aid highway construction contracts of $10,000.00 or more during July 23, 2017 – July 29, 2017 are required to report on the composition of their workforce by job category, gender and ethnicity (pursuant to the Code of Federal Regulations, Title 23, Section 230.121, and federal-aid contract requirements).

If the subcontractor does not submit the FHWA 1391 form by August 11, 2017, the Office of Civil Rights will instruct the prime contractor on the project to obtain the data from the subcontractor.

Any contractor that is nonresponsive may be subject to payment withholding.
